Workers’ Compensation Benefits
The maximum weekly benefit rate for workers' compensation claimants is two-thirds of the New York State Average Weekly Wage (NYSAWW) for the previous calendar year, as determined by the New York State Department of Labor (New York State Workers' Compensation Law Sections 2[16] and 15[6]) on March 31 of each year. The weekly benefit rate is adjusted on July 1 of each year.
The minimum weekly benefit rate is one-fifth of the NYSAWW or the employee's actual wages, whichever is less. In no event shall compensation when combined with decreased earnings or earning capacity exceed the amount of wages the employee was receiving at the time the injury occurred.
The benefit rate an injured worker receives is determined by the date of injury and does not increase if new maximum or minimum benefits are adopted into law.
