Pursuant to Workers' Compensation Law Section 13-d(4), the Chair of the New York State Workers' Compensation Board has exercised his authority to temporarily suspend Dr. Kevin Lowe's authorization to treat injured workers within the New York State workers' compensation system effective July 14, 2014. Dr. Lowe's last known business address is 190-21 Darmans Road, St. Albans, New York 11412.

The Chair's designee's investigation revealed that on February 5, 2014, an Indictment was unsealed against Dr. Lowe in the Southern District of New York alleging that between January of 2011 and approximately February of 2014, he was involved in a massive drug distribution ring that operated out of a medical clinic he owned with multiple locations in Bronx, New York, and was responsible for charging cash for thousands of medically unnecessary prescriptions of Oxycodone, a Schedule II controlled substance, written by clinic doctors. The allegations include one count of conspiracy to distribute and possess with intent to distribute more than five million tablets of Oxycodone in violation of 21 U.S.C. §§ 841(a)(1) and 841(b)(1)(c). The penalty is a maximum sentence of 20 years in prison.

Therefore, the Chair believes that Dr. Lowe may be guilty of misconduct, and that such misconduct would detrimentally affect the quality of care provided to injured workers.

Dr. Lowe is prohibited from rendering treatment and care to injured workers while his authorization is temporarily suspended. Reports submitted by Dr. Lowe for services rendered prior to July 14, 2014, are valid, but are invalid for any services rendered on or after that date. Requests to cross-examine Dr. Lowe for services rendered prior to July 14, 2014, should not be denied due to the suspension of his authorization.
