Pursuant to Workers' Compensation Law Section 13-d(4), the Chair of the New York State Workers' Compensation Board has exercised her authority to temporarily suspend Dr. Michael H. Mark’s authorization to treat injured workers within the New York State workers’ compensation system effective March 12, 2018. Dr. Mark's last known business address is:

The Chair’s designee’s investigation has revealed that the New York State Department of Health, State Board for Professional Medical Conduct (BPMC) has issued Order # 18-042, wherein Dr. Mark agreed not to contest the allegations, including that he is the subject of a Delaware Board Consent Agreement that includes allegations that he prescribed controlled substances to a family member without medical indication and failed to maintain adequate medical records relating to his treatment of the patient. This resulted in a Censure and Reprimand, a limitation on his license to practice medicine in New York State to preclude him from prescribing controlled substances to family members, friends, and employees, a $1,500.00 fine, and the condition that he must successfully complete the terms/conditions in the Delaware Board of Medical Licensure and Discipline Consent and Agreement dated May 12, 2017.

Therefore, the Chair believes that Dr. Mark may be guilty of misconduct, and that such misconduct would detrimentally affect the quality of care provided to injured workers.

Dr. Mark is prohibited from rendering treatment and care to injured workers while his authorization is temporarily suspended. Reports submitted by Dr. Mark for services rendered prior to March 12, 2018, are valid, but are invalid for any services rendered on or after that date. Requests to cross-examine Dr. Mark for services rendered prior to March 12, 2018, should not be denied due to the suspension of his authorization.
