Regulations Public Access to Workers' Compensation Board Records

Personal privacy protection law (PPPL) requests:

Requests to access New York State Workers' Compensation Board (Board) records, or to amend or correct Board records or personal information, made pursuant to the Personal Privacy Protection Law (PPPL), may be made:

  1. By mail to: Privacy Compliance Officer, New York State Workers' Compensation Board, 328 State Street, Schenectady NY 12305-2318.
  2. By email to: RecordsAccess@wcb.ny.gov
  3. In person: at any of the eleven Board District Offices during regular business hours on all days when such office is open for business.

Inspection and copying: Records deemed disclosable under the PPPL by the Board's Privacy Compliance Officer are available for inspection and copying at any of the eleven Board District Offices during regular business hours on all days when such office is open for business.

Fees: The Board is authorized to request a fee of $.25 per page for copies of records released pursuant to the PPPL. Payment is to be made via personal check, certified check, or money order payable to the New York State Workers' Compensation Board.

PPPL Appeals

Under provisions of the PPPL, you may appeal a PPPL determination. If you desire to submit such an appeal, you must do so within 30 days of the written response to your PPPL request. Please include a copy of the original request for records and a copy of the PPPL response letter you received along with your appeal letter to:

Alternatively, you may e-mail your appeal (along with a copy of the original request for records and a copy of the PPPL response letter) to the office of the Executive Director at executive.correspondence@wcb.ny.gov. Please indicate the PPPL Request Number when corresponding on this subject

The Board's deadline for responding to your PPPL appeal is dependent on whether the appeal seeks only access to records (7 business days) or if it seeks correction or amendment to records (30 business days).
