Subject Numbers Regarding Health Provider Authorizations

Pursuant to Workers' Compensation Law Section 13-d(4), the Chair of the New York State Workers' Compensation Board has exercised his authority to temporarily suspend Dr. Frank Kramer’s authorization to perform independent medical examinations within the New York State workers’ compensation system effective March 16, 2015. Dr. Kramer's last known business addresses are One Atwell Road, Cooperstown, NY 13326, and 140 Burwell Street, Little Falls, NY 13365.

The Chair’s designee’s investigation revealed that the New York State Department of Health, State Board for Professional Medical Conduct (BPMC) issued Order # 14-147, wherein Dr. Kramer asserted he could not successfully defend against at least one of the charges alleging negligence on more than one occasion and failing to maintain accurate patient records. As a result, his license was suspended for thirty-six months, stayed with probation for sixty months. Dr. Kramer’s license is limited whereby he is precluded from treating patients for chronic pain in a setting outside of a facility licensed under New York State Public Health Law Article 28. If he should return to practice outside of a facility licensed under New York State Public Health Law Article 28 within the probationary period, the term of his probation will be extended by twelve months. During the period of probation Dr. Kramer may only practice medicine when his practice is being monitored by a physician board certified in an appropriate specialty.

Therefore, the Chair believes that Dr. Kramer may be guilty of misconduct, and that such misconduct would detrimentally affect the quality of care provided to injured workers.

Dr. Kramer is prohibited from performing independent medical examinations of injured workers while his authorization is temporarily suspended. Reports submitted by Dr. Kramer for independent medical examinations performed prior to March 16, 2015, are valid, but are invalid for any independent medical examinations performed on or after that date. Requests to cross-examine Dr. Kramer for independent medical examinations performed prior to March 16, 2015, should not be denied due to the suspension of his authorization.
