Please be advised that, by Determination and Order (BPMC No. 08-231), effective April 2, 2009, the Administrative Review Board of the New York State Department of Health, State Board for Professional Medical Conduct (BPMC), affirmed the December 12, 2008, Hearing Committee's penalty and determination finding Domingo C. Nunez, M.D., guilty of gross negligence and failure to maintain accurate records.

Pursuant to Workers' Compensation Law Section 13-d(5), the Chair of the New York State Workers' Compensation Board has exercised his authority to remove Dr. Nunez from the list of authorized physicians, effective May 19, 2009. Dr. Nunez' last known address is 132 East 76th Street, Suite 2A, New York, New York 10021.

Dr. Nunez is prohibited from rendering medical or other treatment and care to individuals who have suffered work-related injuries or illnesses. Medical reports submitted by Dr. Nunez for treatment rendered prior to May 19, 2009, are valid, but are invalid for any treatment rendered or examinations performed on or after that date. Requests to cross-examine Dr. Nunez regarding treatment he rendered prior to May 19, 2009, should not be denied due to the removal of his name from the list of authorized physicians.
