Please be advised that, by Determination and Order (BPMC No. 06-150) of a Hearing Committee of the New York State Department of Health, State Board for Professional Medical Conduct, effective November 2, 2006, Dr. Enrique M. Bursztyn's license to practice medicine in the State of New York was suspended for one year. By decision of the State of New York Supreme Court, Appellate Division, Third Department, decided and entered July 5, 2007, the determination of the Hearing Committee was confirmed.

By Consent Agreement, executed and accepted on August 28, 2007, Dr. Bursztyn has agreed to a suspension of his authorization to treat workers' compensation claimants commensurate with the suspension imposed by the Hearing Committee of the State Board for Professional Medical Conduct. Therefore, Dr. Bursztyn's authorization to treat claimants is suspended for one year, effective from November 2, 2006, through November 1, 2007. Dr. Bursztyn's current address is 2 Seward Avenue, Utica, New York 13502.

Dr. Bursztyn is prohibited from rendering medical or other treatment and care to individuals who have suffered work-related injuries or illnesses. Medical reports submitted by Dr. Bursztyn for treatment or examinations rendered prior to November 2, 2006, are valid, but are invalid for any treatment or examinations rendered on or after that date. Requests to cross-examine Dr. Bursztyn regarding treatment or examinations he rendered prior to November 2, 2006, should not be denied due to the suspension of his license or this suspension.
