Pursuant to Workers' Compensation Law Section 13-d(4), the Chair of the New York State Workers' Compensation Board has exercised her authority to temporarily suspend Dr. Kimerly Angela Walzer's authorizations to treat injured workers and perform independent medical examinations within the New York State workers' compensation system effective May 29, 2021. The last known practice address for Dr. Walzer, who is also known as Dr. Talerico and Dr. Talarico, is:

The Chair's designee's investigation has revealed that the New York State Education Department has issued Order Number 31262, wherein Dr. Walzer was found guilty of the specification of charges, including that, on or about June 6, 2006, in the United States District Court, Southern District of New York, she was convicted of Conspiracy to Defraud the United States, a felony, in violation of 18 USC § 371, and convicted of Health Care Fraud, a felony, in violation of 18 USC § 1347 and 2 for submitting false and fraudulent insurance claims, based on fictitious injuries of individuals who had been, or claimed to have been, in automobile accidents. This resulted in a $500 fine, a two-year suspension, the last 18 months to be stayed, and a two-year probationary period.

Therefore, the Chair believes that Dr. Walzer may be guilty of misconduct, and that such misconduct would detrimentally affect the quality of care provided to injured workers.

Dr. Walzer is prohibited from rendering treatment and care to injured workers, from performing independent medical examinations, and from conducting reviews of records regarding variance requests pursuant to 12 NYCRR § 324.3(b)(2)(ii)(a), while her authorizations are temporarily suspended. Reports submitted by Dr. Walzer for services rendered prior to May 29, 2021, are valid but are invalid for any services rendered on or after that date. Requests to cross-examine Dr. Walzer for services rendered prior to May 29, 2021, should not be denied due to the suspension of her authorizations.
