The Chair has permanently adopted the addition of Section 329-1.3(d) of Title 12 NYCRR to allow reimbursement for COVID-19 testing when there is a claim for workers' compensation benefits due to workplace exposure to COVID-19.

The Notice of Emergency Adoption and Proposed Rulemaking was published in the December 2, 2020, edition of the State Register. A Notice of Adoption will be published in the April 7, 2021, edition of the State Register.
