Subject Numbers Regarding Health Provider Authorizations

Pursuant to Workers' Compensation Law Section 13-d(2)(a), the Chair of the New York State Workers' Compensation Board has exercised her authority to remove Dr. Richard E. Paulus’ authorization to treat injured workers in the New York State workers’ compensation system effective August 14, 2019. Dr. Paulus’ last known business address is:

The removal is based upon Consent Order (BPMC No. 19-203), August 16, 2019, wherein in full satisfaction of the charges against him, Dr. Paulus did not contest the Statement of Charges, including that on or about May 3, 2019, in United States District Court, Eastern District of Kentucky, he was convicted of one count of Health Care Fraud (18 USC §1347) and ten counts of False Statements Relating to Health Care Matters (18 USC §1035), and sentenced to sixth months imprisonment. The Consent Order precludes Dr. Paulus from practicing medicine in New York State and from practicing medicine in any setting where his practice is based solely on his New York license.

Therefore, the Chair believes that Dr. Paulus may be guilty of misconduct, and that such misconduct would detrimentally affect the quality of care provided to injured workers.

Dr. Paulus is prohibited from rendering treatment and care to injured workers, and from conducting reviews of records regarding variance requests pursuant to 12 NYCRR § 324.3(b)(2)(ii)(a). Reports submitted by Dr. Paulus for services rendered prior to August 14, 2019, are valid, but are invalid for any services rendered on or after that date. Requests to cross-examine Dr. Paulus for services rendered prior to August 14, 2019, should not be denied due to the removal of his authorization.
