Pursuant to Workers' Compensation Law Section 13-d(4), the Chair of the New York State Workers' Compensation Board has exercised her authority to temporarily suspend Dr. William Thomas Delaney’s authorization to treat injured workers within the New York State workers’ compensation system effective December 10, 2018. Dr. Delaney's last known business address is:

The Chair’s designee’s investigation has revealed that the New York State Department of Health, State Board for Professional Medical Conduct (BPMC) has issued a Notice of Referral Proceeding wherein it is alleged that on or about September 18, 2017, Dr. Delaney was arrested on the charges of Driving While Intoxicated, Assault in the Third Degree and Leaving the Scene of a Personal Injury Accident, all misdemeanors under New York State Penal Law and Vehicle and Traffic Law; that on or about February 16, 2018, he was convicted of Driving While Intoxicated, First Offense, a misdemeanor, in violation of New York Vehicle and Traffic Law §1192.3; and that on or about October 6, 2006, he was convicted of Driving While Intoxicated; per se, a misdemeanor, in violation of New York Vehicle and Traffic Law §1192.2.

Therefore, the Chair believes that Dr. Delaney may be guilty of misconduct as described in Education Law §6530(9)(a)(i), and that such misconduct would detrimentally affect the quality of care provided to injured workers.

Dr. Delaney is prohibited from rendering treatment and care to injured workers and from conducting reviews of records regarding variance requests pursuant to 12 NYCRR § 324.3(b)(2)(ii)(a) while his authorization is temporarily suspended. Reports submitted by Dr. Delaney for services rendered prior to December 10, 2018, are valid, but are invalid for any services rendered on or after that date. Requests to cross-examine Dr. Delaney for services rendered prior to December 10, 2018 should not be denied due to the suspension of his authorization.
