Subject Numbers Regarding Health Provider Authorizations

Pursuant to Workers' Compensation Law Section 13-d(2)(a), the Chair of the New York State Workers' Compensation Board has exercised her authority to remove Dr. Martin S. Tesher's authorization to treat injured workers in the New York State workers' compensation system effective July 24, 2018. Dr. Tesher's last known business address is:

Dr. Tesher's authorization to treat injured workers was temporarily suspended by the Board on June 9, 2017 (Subject Number 046-950).

Investigation has revealed that on or about July 18, 2018, Dr. Tesher was convicted of ten (10) counts of illegal distribution of oxycodone, in violation of federal law.

Therefore, the Chair believes that Dr. Tesher may be guilty of misconduct, and that such misconduct warrants his removal from the list of Board authorized providers.

Dr. Tesher is prohibited from rendering treatment and care to injured workers. Reports submitted by Dr. Tesher for services rendered prior to June 9, 2017, are valid but are invalid for any services rendered on or after that date. Requests to cross-examine Dr. Tesher for services rendered prior to June 9, 2017 should not be denied due to the removal of his authorization.
