Pursuant to Workers' Compensation Law Section 13-d(4), the Chair of the New York State Workers' Compensation Board has exercised her authority to temporarily suspend Dr. Christopher T. Foglia’s authorizations to treat injured workers and to perform independent medical examinations in the New York State workers’ compensation system effective for the time period from July 12, 2018, through and including May 21, 2019. Dr. Foglia's last known business address is:

The Chair’s designee’s investigation has revealed that the New York State Department of Education has issued Consent Order No. 30210, wherein Dr. Foglia admitted guilt to one specification, including that between in or about 2016 and in or about 2017, he willfully failed to register with the Division of Professional Licensing Services of the New York State Education Department to practice as a chiropractor in the State of New York. This resulted in a one-year stayed suspension, a one-year probationary period, commencing on May 21, 2018, and a $1,000.00 fine.

Therefore, the Chair believes that Dr. Foglia may be guilty of misconduct as described in Education Law §6509(8), and that such misconduct would detrimentally affect the quality of care provided to injured workers.

Dr. Foglia is prohibited from rendering treatment and care to injured workers and from performing independent medical examinations while his authorizations are temporarily suspended. Reports submitted by Dr. Foglia for services rendered prior to July 12, 2018, and after May 21, 2019, are valid but are invalid for any services rendered during the pendency of his temporary suspension. Requests to cross-examine Dr. Foglia for services rendered prior to July 12, 2018, and after May 21, 2019, should not be denied due to the suspension of his authorizations.
