Pursuant to Workers' Compensation Law Section 13-d(4), the Chair of the New York State Workers' Compensation Board has exercised her authority to temporarily suspend Dr. Elizabeth Marie Rocco’s authorization to treat injured workers within the New York State workers’ compensation system effective September 18, 2017. Dr. Rocco's last known business address is:

The Chair’s designee’s investigation has revealed that the New York State Department of Health, State Board for Professional Medical Conduct (BPMC) has issued Order # 17-249, wherein Dr. Rocco agreed not to contest the allegations, including that during the periods between in or about 2011 through 2015, she failed to render and/or note appropriate care and treatment to multiple patients. This resulted in a thirty-six (36) month probationary period, during which Dr. Rocco may practice medicine only when monitored by a licensed physician, board certified in an appropriate specialty (“Practice Monitor”), and during which she must successfully complete a continuing education program subject to the Director of OPMS’s prior written approval.

Therefore, the Chair believes that Dr. Rocco may be guilty of misconduct, and that such misconduct would detrimentally affect the quality of care provided to injured workers.

Dr. Rocco is prohibited from rendering treatment and care to injured workers while her authorization is temporarily suspended. Reports submitted by Dr. Rocco for services rendered prior to September 18, 2017 are valid, but are invalid for any services rendered on or after that date. Requests to cross-examine Dr. Rocco for services rendered prior to September 18, 2017 should not be denied due to the suspension of her authorization.
