Revocation of Dr. Daniel W. Merk's Authorization to Treat and Conduct Independent Medical Examinations of Workers' Compensation Claimants

Please be advised that, by Order (Vote and Order No. 23452), effective August 1, 2007, the Board of Regents of the University of the State of New York on behalf of the State Education Department, adopted Dr. Merk's application for surrender of his license to practice podiatry.

Pursuant to Workers' Compensation Law Sections 13–k [10] and 13–d [1], the Podiatry Practice Committee of the Workers' Compensation Board recommended to the Chair of the New York State Workers' Compensation Board that Dr. Merk's authorization to treat injured workers in the State of New York be revoked, which recommendation was adopted. Effective December 8, 2008, Dr. Merk's authorization was formally revoked. Dr. Merk's last known address is 738 Apple Tree Court, Henderson, Nevada 89014-3847.

Dr. Merk is prohibited from rendering podiatric treatment and care to and conducting independent medical examinations of individuals who have suffered work–related injuries or illnesses. Medical reports submitted by Dr. Merk for treatment rendered or examinations performed prior to August 1, 2007, are valid, but are invalid for any treatment rendered or examinations performed on or after that date. Requests to cross–examine Dr. Merk regarding treatment he rendered or examinations he performed prior to August 1, 2007, should not be denied due to the surrender of his license or revocation of his authorization.
