Subject Number 046-1676 Temporary Suspension of Dr. Jignyasa Desai

Subject Numbers Regarding Health Provider Authorizations

Authorization No. 262711-5W

March 27, 2024

Pursuant to Workers' Compensation Law Section 13-d(4), the Chair of the New York State Workers' Compensation Board has exercised her authority to temporarily suspend the authorization of Dr. Jignyasa Desai (hereinafter, "the provider") to treat injured workers within the New York State workers' compensation system effective March 26, 2024. The provider's last known business address is:

Vertex Physical Therapy
46 West Suffolk Avenue
Central Islip, New York 11722

Paul Ko's Pain Clinic
3518 150 Place, 1st Floor
Flushing, New York 11354

The Chair's designee's investigation has revealed the New York State Department of Health, State Board for Professional Medical Conduct (BPMC) has issued Determination and Order No. 24-032 dated January 30, 2024, wherein the BPMC has sustained charges that the provider has committed professional misconduct as defined in New York Education Law § 6530(3) and 6530(32), to wit, practicing the profession of medicine with negligence on more than one occasion and failing to maintain a record for each patient which accurately reflects the evaluation and treatment of the patient.

Based on the foregoing finding by the Department of Health that the provider is guilty of misconduct that would detrimentally affect the quality of care provided to injured workers, the Chair has the power and authority to temporarily suspend the provider's authorization to treat injured workers.

The provider is prohibited from rendering treatment and care to injured workers, and from conducting reviews of records regarding variance requests pursuant to 12 New York Codes, Rules and Regulations § 324.3(b)(2)(ii)(a), while their authorization is temporarily suspended. Reports submitted by the provider for services rendered prior to March 26, 2024, are valid but are invalid for any services rendered on or after that date.

Requests to cross-examine the provider for services rendered prior to March 26, 2024, should not be denied due to the suspension of their authorization.

This suspension remains in effect until further notice. Any questions regarding the authorized lists should be referred to the Medical Director's Office at 1 (800) 781-2362.
