Subject Numbers Regarding Health Provider Authorizations

Pursuant to Workers' Compensation Law Section 13-d(4), the Chair of the New York State Workers' Compensation Board ("Chair") had exercised her authority to temporarily suspend the authorization of Dr. Stephen A. DiGiovanni (hereinafter, "the provider") to treat injured workers in the New York State workers' compensation system effective February 5, 2024 (Subject Number 046-1661).

The temporary suspension was based on the Chair's designee's investigation, which revealed that despite multiple written requests, the provider had failed and refused to provide the Board with proof of reimbursement of the sum of $2,811.97 to an injured worker's private health insurer, which sum having also been paid to the provider by the workers' compensation insurer for the same treatment.

Upon receipt of proof of reimbursement, the Chair has rescinded the temporary suspension of the provider and has reinstated their authority to treat injured workers effective March 18, 2024. The Medical Director's Office will restore the provider to the list of providers authorized to treat injured workers as of March 18, 2024.
