Subject Numbers Regarding Health Provider Authorizations

Pursuant to Workers' Compensation Law Section 13-d(4), the Chair of the New York State Workers' Compensation Board has exercised her authority to temporarily suspend the authorization of Jessica Mei Bi, L.Ac (hereinafter, "the provider") to treat injured workers and to perform independent medical examinations within the New York State workers' compensation system effective January 8, 2024. The provider's last known business address is:

The Chair's designee's investigation has revealed that on or about August 21, 2023, the Workers' Compensation Board's Medical Director's Office (MDO) served a letter upon the provider requesting proof of National Certification Commission for Acupuncture and Oriental Medicine (NCCAOM) certification as stated in her application for authorization. To date, the MDO has not received the requested documentation.

As a result of the foregoing, the Chair believes that the provider may be guilty of misconduct under Workers' Compensation Law §13-d(2)(f) for the refusal to produce "any relevant book or paper concerning his or her conduct under any authorization granted to him or her under this chapter."

The provider is prohibited from rendering treatment and care to injured workers, and from conducting reviews of records regarding variance requests pursuant to 12 New York Codes, Rules and Regulations § 324.3(b)(2)(ii)(a), while her authorization is temporarily suspended. Reports submitted by the provider for services rendered prior to January 8, 2024, are valid but are invalid for any services rendered on or after that date. Requests to cross-examine the provider for services rendered prior to January 8, 2024, should not be denied due to the suspension of her authorization.
