Pursuant to Workers' Compensation Law Section 13-d(4), the Chair of the New York State Workers' Compensation Board has exercised her authority to temporarily suspend Dr. Giridhar Cholpady Kamath's authorizations to treat injured workers and perform independent medical examinations within the New York State workers' compensation system effective July 6, 2021. Dr. Kamath's last known business address is:

The Chair's designee's investigation has revealed that the New York State Department of Health, State Board for Professional Medical Conduct (BPMC) has issued Order # 21-119, wherein Dr. Kamath did not contest the Statement of Charges, in full satisfaction of the charges, including that he failed to adequately evaluate chest pain in two patients, failed to refer the patients to a higher level of care, failed to perform an adequate physical examination and/or failed to document performing an adequate physical exam, failed to adequately document medical decision-making to support the assessment and discharge of a patient, and inappropriately prescribed macrolides to a patient. This resulted in a 36 month stayed suspension, and a 36 month probationary period, during which Dr. Kamath may practice medicine only when supervised in his medical practice by a Practice Supervisor, and during which he shall successfully complete a continuing education program as directed by the Office of Professional Medical Conduct.

Therefore, the Chair believes that Dr. Kamath may be guilty of misconduct as described in Education Law §§6530(3) and 6530(32), and that such misconduct would detrimentally affect the quality of care provided to injured workers.

Dr. Kamath is prohibited from rendering treatment and care to injured workers, from performing independent medical examinations, and from conducting reviews of records regarding variance requests pursuant to 12 NYCRR § 324.3(b)(2)(ii)(a), while his authorizations are temporarily suspended. Reports submitted by Dr. Kamath for services rendered prior to July 6, 2021, are valid but are invalid for any services rendered on or after that date. Requests to cross-examine Dr. Kamath for services rendered prior to July 6, 2021, should not be denied due to the suspension of his authorizations.
