The Chair has adopted the amendments to sections 300.17, 300.36, and 300.38 of Title 12 NYCRR to align the regulations with amendments to Workers' Compensation Law section 24 that will take effect January 1, 2023. The amendments establish a set schedule for attorney's fees to be awarded depending on the type of award.
The Notice of Proposed Rule Making was published in the October 5, 2022, edition of the State Register. A Notice of Adoption will be published in the December 28, 2022, edition of the State Register, and the amendments will take effect on January 1, 2023.
