Repeal and Addition of 12 NYCRR Subparts 325-5 and 325-6 (HIMP regulations)


The Board proposed repeal and addition of 12 NYCRR Subparts 325-5 and 325-6. The regulations set forth the rules governing the Health Insurance Matching Program (HIMP).

The regulations set forth the process for determining whether a health insurer is entitled to reimbursement from the workers’ compensation carrier or employer and the procedure for adjudicating disputes. The regulations are effective June 1, 2016. The Notice of Proposed Rule Making was published in the April 8, 2015, edition of the State RegisterLink to External Website. The Board received comments from four stakeholders on the proposed regulations. Several insubstantial changes have been made to the published proposed text. The changes are identified in the Assessment of Public Comment, below.

The Chair adopted the rule on March 21, 2016. The Notice of Adoption will be/was published in the April 6, 2016, edition of the State RegisterLink to External Website.
