Adoption of Amendments to §300.23 and Addition of §300.35 to 12 NYCRR

This proposed rule sets forth the requirements for the suspension of benefits when a claimant is incarcerated for a felony or the maximum benefit weeks expire for a claimant classified as permanently partially disabled and the resumption of benefits when an incarcerated claimant is released. The Notice of Proposed Rule Making and accompanying documents were published in the December 3, 2008, edition of the State RegisterLink to External Website. The Board did not receive any comments on the rule. The Board voted to adopt the rule at its January 27, 2009, meeting. The Notice of Adoption will be/was published in the February 11, 2009, edition of the State Register. The rule is effective once it is published in the State RegisterLink to External Website.
