The Chair proposes amendments to sections 300.17, 300.36, and 300.38 of Title 12 NYCRR to align the regulations to amendments to Workers' Compensation Law section 24 that will take effect January 1, 2023. The current regulations conflict with this statute. The amendments establish a set schedule for attorney's fees to be awarded depending on the type of the award.
The Notice of Proposed Rule Making will be published in the October 5, 2022, edition of the State Register. Comments on the proposal will be accepted for 60 days after publication.
