Pursuant to Workers' Compensation Law Section 13-d(4), the Chair of the New York State Workers' Compensation Board has exercised his authority to temporarily suspend Dr. Shankman’s authorizations to treat injured workers and to perform independent medical examinations in the New York State workers’ compensation system effective August 28, 2017. Dr. Shankman's last known business address is:

The Chair’s designee’s investigation has revealed that on or around August 15, 2017, Dr. Shankman was arraigned in the City of Utica Court and charged with a first-degree scheme to defraud, two counts of third-degree grand larceny, two counts of Workers’ Compensation crime of fraudulent practices, and petite larceny for allegedly certifying he was present during Workers’ Compensation independent medical examinations at his Genesee Street office while he was actually traveling in different parts of the state, out of state, or out of the country, leading to allegedly more than $14,000.00 worth of false insurance billings on behalf of the Workers’ Compensation system.

Therefore, the Chair believes that Dr. Shankman may be guilty of misconduct, and that such misconduct would detrimentally affect the quality of care provided to injured workers.

Dr. Shankman is prohibited from rendering treatment and care to injured workers and from performing independent medical examinations while his authorizations are temporarily suspended. Reports submitted by Dr. Shankman for services rendered prior to August 28, 2017 are valid, but are invalid for any services rendered on or after that date. Requests to cross-examine Dr. Shankman for services rendered prior to August 28, 2017 should not be denied due to the suspension of his authorizations.
