In a letter of September 22, 1998, we inadvertently advised that a Notice of Appeal to the Appellate Division should be filed with the Office of Appeals, 20 Park Street, Albany, NY 12207 [Effective June 29, 2012 all questions should be directed to 328 State Street, Schenectady NY 12305-2318].
As you are aware, Workers' Compensation Board Rule §300.18(a) [12 NYCRR§300.18(a)] provides that the original notice of appeal, with proof of service thereof, shall be served upon the office of the secretary of the board. There has been no modification of this rule. Accordingly, the original Notice of Appeal should continue to be served upon the Office of the Secretary at either of the following addresses:

Any Notice of Appeal to the Appellate Division served in accordance with the September 22, 1998, direction will not be objected to by the Board on a jurisdictional basis.

The instructions communicated by Subject Number 046-87 remain unchanged: It is no longer necessary to file multiple copies of Form RB-89 , Application for Board Review or Form RB-89.1 , Rebuttal of Application for Board Review. In addition, such forms should be filed only with your local District Office of the Board, not with the Office of Appeals in Albany.
