Fee Schedule Changes for Podiatrists

In 2012, Article 141 of NYS Education Law was amended to add new sections of Education Law (7009 and 7010), which expanded the scope of practice of podiatry to allow podiatrists to perform ankle surgery. The law took effect on February 17, 2014.

Accordingly, the podiatry section of the current NYS Workers’ Compensation Medical Fee Schedule (MFS) is modified retroactive to February 17, 2014 to allow qualified Board-authorized podiatrists to bill codes 27600-27745 (excluding 27702, 27703, 27727, 27740 and 27742) as well as CPT codes 27760-27823, 27829, 27840-27871 and 27888-27899 when performing surgical procedures on the ankle. The Relative Value Units and Follow-up days for these codes are the same as those posted in the current Surgery section of the MFS.

In the event that an authorized podiatrist performed ankle surgery in the period subsequent to February 17, 2014 and had a bill denied based on scope of practice or lack of appropriate codes in the MFS, the timeframe for timely billing and report submission has been extended for forty-five days from the date of this notice. The provider can rebill with the appropriate codes and submit for reimbursement.
