In its continuing effort to streamline and improve the process for adjudicating claims, the Workers' Compensation Board is converting paper files to Electronic Case Folders. Once this conversion has been completed, every office and bureau within the Board will have immediate access to the claim file from any location. As a result, it is no longer necessary, or desired, to file multiple copies of Form RB-89, Application for Board Review or Form RB-89.1, Rebuttal of Application for Board Review.
Effective immediately, only ONE such document should be filed for each appeal or rebuttal and it should ONLY be filed with your local District Office of the Board.
Forms RB-89 and RB-89.1 should NOT be filed with the Office of Appeals in Albany. The Electronic Case Folders will be routed to the Office of Appeals by the individual District Offices following scanning of the forms and file preparation performed by Claims. By eliminating the need to reroute hardcopy mail, the timeframe for the processing of appeals will be significantly reduced.
In conjunction with this initiative, the RB-89 and RB-89.1 forms are currently undergoing review to incorporate these and other changes. Supplies of the new forms will be made available to you as soon as possible.
