NYS 2015-16 Budget Eliminates Several
Workers' Compensation Fees

In an effort to promote small business growth in New York, Governor Cuomo has announced the elimination of a number of fees as a part of the 2015-16 State Budget. This action represents the administration's commitment to removing some of the bureaucratic and financial burdens of doing business in New York State.

The following Workers' Compensation Board fees have been eliminated effective April 1, 2015:

Physical Therapists and Occupational Therapists Arbitration Fees 13-g Pre-regulation/per arbitration
Podiatrist Arbitration Fees 13-k Per regulation/per arbitration
Chiropractor Arbitration Fees 13-l Per regulation/per arbitration
Psychologist Arbitration Fees 13-m Pre-regulation/per arbitration
Licensed Hearing Representatives fee 24-a Not to exceed $100 per year
Licensed TPAs 50 (3-b) $100 license fee and $500 authorization fee

In the interim, the current Form HP-1 Request for Arbitration should continue to be used, however, without a fee. The form should be sent to the address under checkbox B until further notice.

The elimination of these Workers’ Compensation Board fees will save an estimated $95,000 for individuals and businesses in New York. Across all affected agencies, the total annual savings is expected to be $3 million.
