Subject No. 046-598

Temporary Suspension of Dr. Heather Pearman's
Authorization to Treat Injured Workers
Effective July 25, 2013

Authorization No. C09569-7W

Date: August 7, 2013

Pursuant to Workers' Compensation Law Section 13-d(4), the Chair of the New York State Workers' Compensation Board has exercised his authority to temporarily suspend Dr. Heather Pearman's authorization to treat injured workers within the New York State workers' compensation system effective July 25, 2013. Dr. Pearman's last known business address is 144A Fifth Avenue, Pelham, New York 10803.

The Chair's designee's investigation revealed that on July 16, 2012, the New York State Education Department, Office of Professional Discipline State Board for Chiropractic granted Dr. Pearman's application for a consent order in which she plead guilty to charges of gross negligence, specifically, using nutrition not as an adjunct to a chiropractic practice but as a sole means or practice and failing to keep adequate patient records. She agreed to a two year license suspension, a two year probationary term, and a $500.00 fine. Therefore, the Chair believes that Dr. Pearman may be guilty of misconduct.

Dr. Pearman had her authorization to conduct independent medical examinations removed by the Board on November 29, 2012.

Dr. Pearman is prohibited from rendering treatment and care to injured workers while her authorization is temporarily suspended. Reports submitted by Dr. Pearman for services rendered prior to July 25, 2013, are valid, but are invalid for any services rendered on or after that date. Requests to cross-examine Dr. Pearman for services rendered prior to July 25, 2013, should not be denied due to the suspension of her authorization.

This suspension remains in effect until further notice. Any questions regarding the authorized lists should be referred to the Medical Director's Office at 1 (800) 781-2362.
