Subject No. 046-1221

Removal of Dr. Douglas A. Marcus

Authorization No. 120774-5W

Date: October 22, 2019

Pursuant to Workers' Compensation Law Section 13-d(2)(a), the Chair of the New York State Workers' Compensation Board has exercised her authority to remove Dr. Douglas A. Marcus’ authorization to treat injured workers in the New York State workers’ compensation system effective September 13, 2019. Dr. Marcus’ last known business address is:

34 Elm Street, Great Neck
New York 11021

The removal is based upon Consent Order (BPMC No. 19-232), effective September 10, 2019, wherein Dr. Marcus could not successfully defend against at least one of the acts of misconduct alleged against him, including that during the periods from in or about 2002 through in or about 2017, he failed to render and/or note appropriate care and treatment to multiple patients, and prescribed controlled substances in an inappropriate manner to these patients. This resulted in a limitation on Dr. Marcus’ license to preclude him from prescribing, dispensing, ordering and/or administering any controlled substances effective September 16, 2019, and that, effective September 30, 2019, he shall be subject to a limitation precluding registration or issuance of any further license, and shall be precluded from practicing medicine in New York State, or any setting where his practice is based solely on his New York State license.

Therefore, the Chair believes that Dr. Marcus may be guilty of misconduct, and that such misconduct would detrimentally affect the quality of care provided to injured workers.

Dr. Marcus is prohibited from rendering treatment and care to injured workers, and from conducting reviews of records regarding variance requests pursuant to 12 NYCRR § 324.3(b)(2)(ii)(a). Reports submitted by Dr. Marcus for services rendered prior September 13, 2019, are valid, but are invalid for any services rendered on or after that date. Requests to cross-examine Dr. Marcus for services rendered prior to September 13, 2019, should not be denied due to the removal of his authorization.

Any questions regarding the authorized lists should be referred to the Medical Director’s Office at 1 (800) 781-2362.
