Pursuant to Workers' Compensation Law Section 13-d(4), the Chair of the New York State Workers' Compensation Board has exercised her authority to temporarily suspend Dr. Larry J. Shemen’s authorization to treat injured workers within the New York State workers’ compensation system for the period of six months, commencing on August 19, 2019. Dr. Shemen's last known business addresses are:

The Chair’s designee’s investigation has revealed that the New York State Department of Health, State Board for Professional Medical Conduct (BPMC) has issued Order # 19-176, wherein Dr. Shemen agreed not to contest the allegations, in full satisfaction of the charges against him, including that, after purchasing a medical practice, on or about October 20, 2017, he informed a patient of the prior medical provider that his medical record was destroyed when his record should have been maintained until on or about April 23, 2019, and that Dr. Shemen last updated his physician profile on or about December 22, 2008, despite registering in 2010, 2012, 2014, 2016, and 2018.

Therefore, the Chair believes that Dr. Shemen may be guilty of misconduct as described in Education Law §6530(32) and §6530(16), and that such misconduct would detrimentally affect the quality of care provided to injured workers.

Dr. Shemen is prohibited from rendering treatment and care to injured workers and from conducting reviews of records regarding variance requests pursuant to 12 NYCRR § 324.3(b)(2)(ii)(a) while his authorization is temporarily suspended. Reports submitted by Dr. Shemen for services rendered prior to August 19, 2019, are valid but are invalid for any services rendered on or after that date. Requests to cross-examine Dr. Shemen for services rendered prior to August 19, 2019, should not be denied due to the suspension of his authorization.
