Pursuant to Workers' Compensation Law Section 13-d(4), the Chair of the New York State Workers' Compensation Board has exercised her authority to temporarily suspend Dr. Ogedi Ohajekwe’s authorizations to treat injured workers and to perform independent medical examinations in the New York State workers’ compensation system effective November 13, 2017.

The Chair’s designee’s investigation has revealed that the New York State Department of Health, State Board for Professional Medical Conduct (BPMC) has issued Order of Conditions # 15-212, wherein for a period of three (3) years Dr. Ohajekwe shall be subject to “Practice Conditions”, including that he may practice medicine only when monitored by a licensed physician, board certified in an appropriate specialty (“Practice Monitor”), and that he must complete a continuing education program in an area to be specified by the Office of Professional Medical Conduct.

Further investigation has revealed that, pursuant to expert peer review, Dr. Ohajekwe was found to have deviated from the standard of care with respect to maintaining proper documentation and in sending a patient to the OR.

Therefore, the Chair believes that Dr. Ohajekwe may be guilty of misconduct, and that such misconduct would detrimentally affect the quality of care provided to injured workers.

Dr. Ohajekwe is prohibited from rendering treatment and care to injured workers and from performing independent medical examinations while his authorizations are temporarily suspended. Reports submitted by Dr. Ohajekwe for services rendered prior to November 13, 2017 are valid, but are invalid for any services rendered on or after that date. Requests to cross-examine Dr. Ohajekwe for services rendered prior to November 13, 2017 should not be denied due to the suspension of his authorizations.
