Webinar on Timeliness of Controversies: Measuring and Monitoring Payer Performance

The New York State Workers' Compensation Board is holding a webinar, Timeliness of Controversies: Measuring and Monitoring Payer Performance, on June 26, 2017, at 1 p.m. and again on June 29, 2017, at 1 p.m. This webinar will review the process the Board will soon implement and identify the steps stakeholders must take. This webinar is valuable because it explains what the Board is measuring regarding the timeliness of controversy and how we are monitoring compliance. It also addresses which actions are measured and the request for review process. This is particularly important information because the NYS Workers' Compensation Board will begin issuing penalties against insurance carriers, self-insured employers and municipalities for the late filing of controversies for the third quarter of 2017, which covers the period July through September. Any penalties issued in October 2017 will cover the third quarter of 2017.

Payers that meet the established performance goal for timely controversy per §25(3)(e) will not be issued penalties in that category. The performance goal for timely controversy per §25(3)(e) for the third quarter of 2017 is 70%. It will increase 5% each subsequent quarter until it reaches 85%. Once set at 85%, goals will be periodically reviewed, with additional increases possible based on statewide performance. In keeping with the provisions and intent of the law, penalties payable to the claimant for timely controversy per §25(2)(a) will not be waived even if performance goals are met.

All penalties will include an opportunity to request review of each non-compliant filing.
