The Chair proposes the Revised addition of subdivision (g) to section 324.2 of Title 12 NYCRR to provide the option for telehealth visits in some circumstances. The Chair also proposes the addition of section 329-1.4 of Title 12 NYCRR to define Intraoperative Neurophysiological Monitoring (IOM) and to clarify that remote IOM is prohibited, except in very limited circumstances.

The Notice of Proposed Rulemaking for the revised addition of subdivision (g) to section 324.2 of Title 12 NYCRR was published in the July 14, 2021, edition of the State Register, and the Notice of Revised Rulemaking was published in the March 2, 2022, edition of the State Register. Comments on the revised proposal will be accepted for 45 days after publication.

The Notice of Proposed Rule Making for the addition of 12 NYCRR 329-1.4 was published in the March 2, 2022, edition of the State Register. Comments on the proposal will be accepted for 60 days after publication. Please submit comments by emailing regulations@wcb.ny.gov.
